Summary of California Weapon Offenses

In California, gun ownership and possession are legal. If you are 18 years old or older and not prohibited from owning a gun, you may have a loaded or unloaded gun in your home, temporary residence, campsite or place of business. There are a number of limitations on possession and concealed carry, which can lead to felony or misdemeanor charges. For example, if you are convicted of a felony, you may be prohibited from carrying a gun for life. For certain misdemeanor offenses, you may be prohibited from owning a gun for 10 years. You are also prohibited from bringing a gun into places like a school or airport.

Some common weapons-related charges are the following:

Felon in Possession of a Firearm (Penal Code Section 29800): A person who has been convicted of a felony is prohibited from owning any type of firearm for the rest of their life. If you are caught with a gun, whether someone gave it to you, or someone in your household owned it, you could be charged with this crime.

Unlawful Discharge of a Firearm (Penal Code Section 246.3): Willfully discharging a firearm or BB gun in a way that could result in injury or death to someone else. This will be a misdemeanor or felony depending on the weapon.
